1.1 These terms and conditions of use (Terms) govern your access to and use of the website (Site).
1.2 These Terms apply between Roaming Vines (we, us or our) and you, the person accessing or using the Site (you or your).
1.3 You should read these Terms carefully before using the Site. By using the Site or otherwise indicating your consent to these Terms, you agree to be bound by them. If you do not agree to any of these Terms, you should stop using the Site immediately.
1.4 These Terms apply to all parts of the Site, including its functionality and content, provided to you free of charge for information purposes only. They do not govern the sale and supply of goods, services or digital content (Products) purchased by you from us or from third parties through the Site. 1.5 In the event of a conflict, these Terms will govern your general use of the Site, and the Booking Terms will govern any Product purchases made through the Site.
1.6 Your use of the Site is also subject to our Privacy Policy, Cookies Policy and Fake Reviews Policy.

5.4 While we try to ensure that the Site is secure, we do not actively monitor or check whether information supplied to us through the Site is confidential, commercially sensitive or valuable.
6. Availability, Changes and Access to the Site
6.1 We aim to keep the Site available and functioning reliably. However, the Site may be temporarily unavailable due to maintenance, updates, technical faults or events outside our control.
6.2 We may update or change the Site to:
6.2.1 improve its functionality, security or performance;

Except for Product descriptions and booking details, which are covered by our Booking Terms, any reliance you place on information on the Site is at your own risk.

8.1 The Site, including its software, design, text, images, video, audio, multimedia content and other information or material available on the Site (Content), is owned by us or our licensors and is protected by intellectual property laws.
8.2 Nothing in these Terms grants you any legal rights in the Site or the Content other than those necessary for you to access and use the Site in accordance with these Terms.
8.3 By using the Site, you agree not to copy, reproduce, distribute, create or modify derivative works from the Site or its Content. You also agree not to alter, delete or attempt to circumvent any notices, including intellectual property notices, associated with the Content.
8.4 Unless you have our prior written permission, you must not:
8.4.1 use any automated process, software or script to extract, scrape, crawl or collect data or Content from the Site in any manner, including through the use of web crawlers, bots or spiders;
8.4.2 aggregate, collect or compile Content for commercial or non-commercial purposes. This includes, but is not limited to, using Content to create databases, directories or other aggregated collections;

This includes, but is not limited to, using the Content to train AI models, for any form of automated content generation, or as an input to an AI system in the form of a prompt, request, question, instruction or similar.
8.5 By accessing or using the Site, you agree to comply with the restrictions in this clause. Any attempt to bypass these restrictions may result in legal action and/or termination of access to the Site in accordance with Clause 11 (Suspension and Termination).

9.1 The Site may contain hyperlinks or references to third-party advertising or websites. Any hyperlinks or references are provided for your convenience only.
9.2 We have no control over third-party advertising or websites and accept no legal responsibility for any content, material or information contained in them. The display of any hyperlink or reference to a third-party website does not mean that we endorse that website or its Products or services.
9.3 If the Site integrates third-party services (such as payment providers), or you choose to click on a hyperlink to a third-party service, your use of that third-party site may be subject to the third party’s terms and privacy policies.
10. Our Responsibility to You
10.1 If we breach these Terms or are negligent, we are responsible to you for loss or damage you suffer that is a foreseeable result of our breach or negligence. By foreseeable, we mean that, at the time these Terms formed a relationship between you and us, it was either clear that the loss or damage would occur or we both knew that it might reasonably occur as a result of something we did or failed to do.
10.2 We are not responsible for any loss or damage that was not foreseeable. We are not responsible for any loss or damage that was not caused by us, that resulted from your breach of these Terms, or that resulted from your internet connection or any third-party systems outside our control.
10.3 This Site is for your personal use only. We therefore do not accept responsibility for any business loss or damage.
10.4 We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these Terms limits the rights and remedies to which you are entitled under consumer protection laws.

13.2 If your complaint relates to a purchase, delivery, return, refund or cancellation, please refer to our Booking Terms.
14. General Legal Terms
14.1 Changes to these Terms. We may make changes to these Terms to reflect changes in law or regulation, changes to the Site and its functionality, security requirements or operational reasons. When we do so, the updated Terms will be displayed on the Site. If you continue to use or access the Site following these changes, you agree to be bound by the updated Terms.
14.2 Events beyond our control. We are not liable to you if we fail to comply with these Terms because of events beyond our reasonable control.
14.3 No waiver. If we do not enforce a provision of these Terms immediately, we do not waive our right to do so later.
14.4 Severability. If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will remain in full force and effect.
14.5 No third-party rights. No one other than you or us has any right to enforce any of these Terms.
14.6 Governing law. The laws of England and Wales apply to these Terms. However, if you are resident elsewhere in the UK, you will retain the benefit of any mandatory protections afforded to you by the laws of the country in which you reside.
14.7 Jurisdiction. Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.
